These Terms and Conditions set out the basis on which House Clearance Hackney provides house clearance, waste removal and related services to domestic and commercial customers. By making a booking, confirming a quotation, or allowing our operatives to commence work at the premises, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following definitions apply:

Customer means the person, firm or company who requests or purchases services from House Clearance Hackney.

Services means any house clearance, waste collection, waste removal, bulky item removal, or associated work carried out by House Clearance Hackney.

Premises means the property, land or location at which the Services are to be performed.

Waste means any items, materials, furniture, appliances, or other goods to be collected and removed as part of the Services.

2. Scope of Services

House Clearance Hackney provides house clearance and waste collection services, including removal of general household items, furniture, small electrical goods, and certain types of commercial waste. The precise scope of the Services will be agreed with you at the time of booking and confirmed in writing where practicable.

We reserve the right to refuse removal of any items that we reasonably believe may be hazardous, illegal, excessively heavy, contaminated, or otherwise unsuitable for collection, transport or disposal under applicable law or health and safety guidelines.

3. Booking Process

3.1 You may request a quotation or make a booking by telephone, email, or online form. When doing so, you must provide accurate and complete information about the Premises, the type and volume of Waste, access restrictions, parking conditions and any relevant time constraints.

3.2 Any quotation given prior to visiting the Premises is an estimate based on the information you have supplied. The final price may change if the Waste volume, weight, type, access or working conditions differ from what was originally described.

3.3 Your booking is not confirmed until it has been accepted by House Clearance Hackney. Acceptance may be given verbally or in writing and is subject to availability of personnel, vehicles and resources on the requested date and time.

3.4 We may request photographs or a detailed list of items prior to confirming a booking in order to assess the expected load, access and time requirements.

4. Access, Parking and Customer Responsibilities

4.1 You are responsible for ensuring that our operatives have safe, reasonable and lawful access to the Premises at the agreed time. This includes arranging access through any communal areas and securing permission from building managers or landlords where required.

4.2 You must ensure that adequate parking or stopping space is available as close as reasonably possible to the Premises. Any parking charges, permits or penalties incurred as a result of carrying out the Services may be added to your final invoice.

4.3 You agree to provide any necessary information regarding fragile items, hidden hazards, or special handling requirements. Items such as sharp objects, broken glass, chemicals, or other potentially dangerous materials must be disclosed in advance.

4.4 You must ensure that children, pets and other occupants are kept at a safe distance from the working area during the provision of the Services.

5. Pricing and Quotations

5.1 Prices are generally based on a combination of Waste volume, approximate weight, type of items, labour time, accessibility and any disposal or recycling charges imposed by waste facilities.

5.2 Any quotation given is valid for a limited period, which will be stated at the time of issue. We reserve the right to withdraw or amend a quotation at any time before accepting your booking.

5.3 Where, upon arrival, the scope of work is significantly different from what was originally described, we will explain any change in price before commencing work. If you do not accept the revised price, we may cancel the booking and no Services will be provided, subject to any applicable call-out or cancellation fees.

6. Payments and Invoicing

6.1 Payment terms will be communicated at the time of booking. Unless otherwise agreed in writing, payment is due in full on completion of the Services and prior to our vehicle leaving the Premises.

6.2 We may accept payment by cash, debit card, credit card, or bank transfer, subject to the options made available to you at the time of booking or service.

6.3 For commercial or account customers, alternative invoicing and payment terms may be agreed in writing. Where credit terms are approved, payment must be made by the due date on the invoice. Late payments may incur interest and administration fees in line with applicable legislation.

6.4 If you fail to pay any amount due, we may withhold further Services, pursue recovery of the outstanding sum, and recover all reasonable costs associated with such recovery, including legal fees and collection charges.

7. Cancellations and Amendments

7.1 You may cancel or amend a booking by contacting us directly. We encourage you to provide as much notice as possible if you wish to cancel or change your appointment.

7.2 Cancellations made more than 24 hours before the scheduled arrival time will generally not incur a cancellation fee, unless special arrangements or non-refundable costs have been agreed in advance.

7.3 Cancellations made less than 24 hours before the scheduled arrival time may incur a cancellation charge to cover allocated labour, vehicle scheduling and administrative costs.

7.4 If our operatives attend the Premises at the agreed time and are unable to gain access, or the work cannot proceed due to circumstances within your control, this may be treated as a late cancellation and a call-out fee or cancellation charge may apply.

7.5 House Clearance Hackney reserves the right to cancel or reschedule a booking due to circumstances beyond our reasonable control, such as severe weather, vehicle breakdown, illness, accidents, or other operational issues. In such cases, we will notify you as soon as reasonably practicable and offer an alternative date or a refund of any pre-paid amounts for Services not carried out.

8. Waste Handling and Regulations

8.1 House Clearance Hackney operates in accordance with applicable UK waste management legislation and environmental regulations. We aim to dispose of or recycle Waste in a lawful and responsible manner.

8.2 Certain types of waste are classified as hazardous or require specialist handling or permits, such as asbestos, chemicals, oils, gas bottles, clinical waste and some electrical items. You must inform us in advance if such materials are present. We may refuse to collect such items or may apply additional charges where specialist disposal is required.

8.3 We will transport Waste only to licensed waste transfer stations, recycling facilities, or other lawful disposal or recovery sites. Once Waste has been removed from the Premises and loaded into our vehicle, it becomes our responsibility and you relinquish ownership of those items.

8.4 You confirm that you have the lawful authority to transfer the Waste to us and that the Waste does not contain any items obtained illegally or in breach of any third-party rights.

9. Customer Items and Valuables

9.1 Before the Services commence, you must remove or clearly separate any items that you wish to keep from those that are to be taken away as Waste. Our operatives will treat all items presented to them in the working area and agreed rooms as Waste to be removed, unless clearly marked or instructed otherwise.

9.2 House Clearance Hackney shall not be responsible for any loss of items that were inadvertently included in the Waste due to failure to separate or identify them clearly.

9.3 We may, at our discretion, agree to set aside items of potential value for your inspection before removal. Any such arrangements must be agreed in advance and confirmed with the team on site.

10. Liability and Limitations

10.1 House Clearance Hackney will exercise reasonable care and skill in providing the Services. However, minor scuffs, marks or wear may occur during the normal process of moving bulky items in restricted spaces. We will not be liable for cosmetic damage to walls, floors, doors or fixtures that is reasonably incidental to the nature of the Services, provided we have acted with reasonable care.

10.2 You must notify us in writing of any alleged damage or loss arising from our Services as soon as reasonably possible, and in any event within seven days of completion of the work. We may request photographs, access for inspection and any supporting evidence before considering a claim.

10.3 Our total liability for any loss, damage or claim arising out of or in connection with the Services, whether in contract, tort or otherwise, shall not exceed the total amount paid or payable by you for the specific booking from which the claim arises, except where such limitation is not permitted by law.

10.4 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which liability cannot lawfully be excluded or limited.

11. Insurance

11.1 House Clearance Hackney maintains appropriate public liability insurance and, where applicable, employer liability insurance to cover the provision of our Services.

11.2 The existence of insurance does not extend or increase our liability beyond the limits set out in these Terms and Conditions, nor does it create any direct rights for you against our insurers.

12. Health and Safety

12.1 We are committed to maintaining high standards of health and safety for our staff, customers and the public. Our operatives may refuse to carry out work that they reasonably consider unsafe or likely to cause injury or damage.

12.2 You agree to co-operate with any reasonable health and safety instructions given by our operatives, including temporarily restricting access to certain areas while work is being carried out.

13. Delays and Force Majeure

13.1 While we aim to attend at the agreed time, arrival and completion times are estimates only. We are not liable for any loss or inconvenience arising from delays that are outside of our reasonable control, including traffic, weather, road closures, accidents, or third-party actions.

13.2 We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events, circumstances or causes beyond our reasonable control, including but not limited to natural disasters, strikes, lockouts, civil unrest, acts of government, or disruption to utilities and transport networks.

14. Complaints

14.1 If you are dissatisfied with any aspect of our Services, you should raise the issue with our office as soon as possible so that we have an opportunity to address your concerns.

14.2 We will investigate complaints in a fair and timely manner and may request further information or evidence where required. Where appropriate, we may offer to rectify issues, provide a partial refund, or take other remedial action at our discretion.

15. Data Protection and Privacy

15.1 In providing our Services, we may collect and process personal information such as your name, contact details, address and payment information. We will handle personal data in accordance with applicable data protection laws in the United Kingdom.

15.2 We use such information for the purposes of administering bookings, providing Services, arranging payments, and, where permitted, communicating with you about our services. We will not sell your personal data to third parties.

16. Amendments to Terms and Conditions

16.1 House Clearance Hackney may amend these Terms and Conditions from time to time. Any updated version will apply to new bookings from the date on which the revised terms are made available.

16.2 For ongoing or pre-booked Services, the version of the Terms and Conditions in force at the time of your booking will generally apply, unless a change is required by law or regulatory authority.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by House Clearance Hackney.

18. General Provisions

18.1 If any provision of these Terms and Conditions is held by a court or competent authority to be invalid, illegal or unenforceable, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.

18.2 No failure or delay by House Clearance Hackney in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that right or remedy, nor shall it prevent or restrict any further exercise of that or any other right or remedy.

18.3 These Terms and Conditions constitute the entire agreement between you and House Clearance Hackney in relation to the provision of the Services and supersede any prior understandings, representations or agreements, whether written or oral.
